These Terms of Service ("Terms") are an agreement between you and FieldBinder AI ("FieldBinder," "we," "us") governing your use of the fieldbinder.ai website, the early access program, and — when released — the FieldBinder AI iPhone application and companion web portal (together, the "Service").
By accessing or using the Service, you agree to these Terms. If you're using the Service on behalf of a company, you represent that you have authority to bind that company, and "you" includes the company.
FieldBinder AI is a field documentation and reporting tool. It lets users capture project information — photos, short videos, notes, voice memos, measurements, and field items — organized by project, and uses AI to help draft documentation such as daily reports, punch lists, RFI lists, and executive summaries.
Today, the Service consists of this website and the early access program. The app and web portal are in development; features described on this site reflect what we're building and may change before and after release.
You must be at least 18 years old to use the Service. The Service is designed for professional and business use.
Joining the early access list means we'll contact you about the launch and may invite you to test pre-release versions. Early access and any pre-release software are provided as-is, may contain bugs, and may change or be discontinued at any time. We make no commitment that any particular feature, plan, or price described during early access will exist at launch.
If you give us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free right to use them without restriction or obligation to you.
When accounts launch, you agree to provide accurate information, keep your credentials secure, and notify us promptly of any unauthorized use. You're responsible for activity that occurs under your account.
You own your content. Photos, videos, voice memos, notes, files, project details, and reports you create remain yours.
To operate the Service, you grant us a limited, worldwide, non-exclusive license to host, store, process, transmit, and display your content — solely as needed to provide, maintain, secure, and improve the Service for you (including processing content through AI features you use). This license ends when your content is deleted from the Service, subject to routine backup cycles.
You're responsible for having the rights to the content you capture and for your use of it — including any permissions required to photograph or record at a given site.
AI-generated reports are editable drafts. Users are responsible for reviewing all generated content for accuracy, completeness, and suitability before sharing or relying on it.
FieldBinder AI is a documentation and drafting assistant. It is not a licensed engineering, legal, safety, or compliance authority, and its output is not professional advice. AI systems can produce errors, omissions, or misdescriptions. Nothing generated by the Service should be relied on for any engineering, safety, legal, financial, or compliance decision without review by you and, where appropriate, a qualified professional.

The Service — including its software, design, branding, and content we create — is owned by FieldBinder AI and protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights. "FieldBinder AI" and our logo may not be used without our permission.
The Service relies on third-party providers — such as Apple (distribution and billing), cloud hosting and storage providers, and AI processing providers. Their services are subject to their own terms, and we're not responsible for third-party services we don't control.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDBINDER AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold FieldBinder AI harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
You can stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including 7–14 and 17) survive.
We're an early-stage product and the Service will evolve. We may update these Terms from time to time; if changes are material, we'll take reasonable steps to notify you (for example, by email or in-app notice). Continued use of the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules. Courts located in Ohio will have exclusive jurisdiction over disputes arising from these Terms or the Service, and you consent to their jurisdiction.
